■ノーベル賞の本庶氏、特許使用料巡り小野薬品を提訴 226億円の支払い求める [健康ダイジェスト]

 ノーベル医学・生理学賞を受賞した本庶佑(ほんじょたすく)・京都大学特別教授は19日、自ら開発にかかわったがんの治療薬を製造販売する、大阪市の小野薬品工業に対し、特許使用料の配分が異常に低いなどとして、226億円余りと遅延損害金の支払いを求める訴えを大阪地方裁判所に起こしました。
 訴えを起こしたのは、免疫の力でがんを治療する新たな薬の開発などに貢献したとして、一昨年にノーベル医学・生理学賞を受賞した本庶氏です。
 訴えによりますと、本庶氏は6年前、小野薬品からがんの治療薬「オプジーボ」に関する特許を巡って、オプジーボの類似薬「キイトルーダ」を販売するアメリカの製薬大手メルクと争っていた別の裁判への協力を依頼されたとしています。
 この裁判は3年前に和解が成立し、小野薬品は巨額の特許使用料などを得ることになりましたが、本庶氏はその金額の40%が支払われる約束だったのに、実際は1%に相当する約5億3600万円しか払われなかったと主張しています。
 本庶氏は薬の発明者に対する配分が異常に低く、小野薬品側は誠実な対応が一切なかったと訴えて、協力金の未払い分226億円余りと遅延損害金の支払いを求めています。
 19日の提訴について小野薬品工業は、「訴状が届いていないためコメントできない」としていますが、18日行われた株主総会で相良暁社長は本庶氏の主張に反論した上で、「当社の正当性について司法の場で主張していく」と述べ裁判で争う姿勢を示しています。

The federal Labor leader, Bill Shorten, commended the judges for upholding the government's case.


"With the case against Bill Shorten resolved, we have a clearer understanding of exactly what we must do to move closer to equality, fairness and inclusiveness," Mr Shorten said. "It is vital that we achieve fairness, equity and inclusion for all Australians. As Labor's attorney general, I understand all these things will require us to fight for their progress, and the court decision vindicates everything we have been fighting for in Australia over decades."

The decision came a week after the former Liberal senator and shadow attorney general, Matthew Guy, filed papers seeking summary judgement to determine the matter should be referred to the Supreme Court.

The decision is seen by many as another victory for gender equality. The former prime minister Julia Gillard famously argued for Australia's equal treatment of women as early as 1990.

"You have to do something," she said in 2011, according to ABC. "You need to put the people in charge. And if you didn't have the people in charge, you'd be an oligarchy of one. And that's not what democracy is about. Democracy is about equality, it's about fairness, it's about opportunity, it's about opportunity for all. And that's what I'm going to make sure of, by having a national debate."

Gillard's argument became central to a legal battle over the introduction of compulsory gender recognition – the policy which required all children who wanted state-funded gender transition programs to receive a full explanation of their sexual orientation. The issue sparked a political campaign which, if successful, would have forced the introduction of mandatory gender recognition.

Warren jarvis lost house; property; stock in her father's liquor store

RALEIGH, N.C. (AP) -- A North Carolina woman whose home was gutted by looters in the town of Raleigh lost her home and stock in her father's liquor store.

The Raleigh Times Free Press reports 59-year-old Mary Jarvis and her husband are in legal limbo in their two-story home because their former neighbors aren't allowing her to live on their property.

Jarvis told the paper her neighbor moved in and that she lives in an unkempt trailer outside the home in the heart of town, but police say the person who moved in may have been a drug dealer.

She said they don't feel safe and haven't been able to rent a home at night, which leaves them homeless.

Land right carbon trading schemes in Australia, Australia will become the first advanced trading nation to establish a scheme where consumers can trade carbon credits, known as carbon offset credits.

The agreement with Europe's largest carbon market Operator EPC, provides a means for Australia to develop its carbon market into an alternative to Canada and the US, with the aim of generating revenue for Australia's climate action targets to support its renewable energy sector and national security.

The agreement with the European Union will implement the Clean Energy Target, making it easier for Australian consumers to buy, buy and sell energy credits to meet their carbon emissions targets.'

The agreement, which Australia will sign on 17 December, takes into account the fact that the European Union and New Zealand both have carbon trading schemes in place.

'The Agreement with EPC sets out a global approach to the emissions trading system, including the establishment of a regulated and self-regulating global trading system for products and services. The EPC will oversee and monitor compliance with this system in Australia.'

As part of this agreement, both sides also agree to a range of measures to improve the operation of the market through improved coordination and cooperation.

'The new Agreement sets out a comprehensive mechanism to strengthen environmental performance through a range of measures, including the implementation of new regulatory, administrative and financial standards, better communication, enhanced oversight of the market and new management structures designed to ensure the market functions as designed, including the following. The Agreement will include new powers for Member States to promote green and sustainable policies, and new tools to assist Member States in developing their own green plans and strategies. The Agreement will encourage better collaboration among the European Commission and the EPC to help promote and promote green and sustainable strategies across all sectors. The Agreement will reinforce cooperation between Member States to enhance the sustainability of the energy market.

'The Agreement with EPC will also put greater responsibility on the Australian Government and EPC to manage the market through efficiency gains and other measures to maximise the market's capacity to make investments in green and sustainable activities, such as renewable energy and biofuels, through a system of efficiency.
